Debt recovery and enforcement in Bodrum
Individuals, companies and foreign clients can seek advice in English about unpaid invoices, contractual debts or an enforcement document received in Turkey. The initial review identifies the supporting documents, the current stage and the position of the creditor or debtor.
An enforcement review begins with the basis of the debt, the type of proceedings and the current stage of the file. Assessing recovery options for a creditor and preparing a response to a payment order or another measure for a debtor require different work. The documents and service information are established at the outset.
Reviewing a debt before proceedings
Contracts, invoices, delivery records, payments, account reconciliations and any court decision are considered together. Principal, interest, costs and other items are distinguished, and previous payments, deductions and objections are examined. The person against whom proceedings are proposed, their basis and the available procedure depend on the nature of the supporting documents and the applicable requirements.
Payment orders and procedural steps
A document received by a debtor is reviewed for the type of proceedings, the manner and date of service, the amount claimed and its basis. A proposed challenge to the debt, jurisdiction or a procedural measure requires assessment of the appropriate route and time limit against the actual document. For a creditor, the effects of an objection, steps needed to continue and any additional court proceedings are considered.
Attachment, sale and financial difficulty
At attachment, valuation, sale or distribution stages, the relevant records and rights require separate review. A payment plan or settlement proposal is assessed for its amount, schedule, security and consequences of non-performance. Where company financial difficulty, restructuring through concordat proceedings or bankruptcy is reported, the particular procedure and its effects receive a separate assessment.
Documents for the initial review
The application, payment or enforcement order, service records, supporting documents, account statement, payment receipts, objections or complaints and existing decisions should be available. If there are several files, the connection between each payment and the relevant file should be identified.
