Construction law and disputes in Bodrum
Landowners, property owners and contractors can seek advice in English on construction-for-share agreements, building and renovation contracts, delays, defects and disputes over handover in Bodrum.
Construction matters require the contractual obligations and the technical scope of the work to be reviewed together. In a construction-for-land-share, building, renovation or other works contract, the obligations of the landowner, employer and contractor need to be established. For a project in Bodrum, property records, permit documents and actual progress may also form part of the review.
The agreement and its annexes
The scope of work, technical specifications, delivery programme, payment or unit transfer conditions and security arrangements are considered together. The agreement should address approval of project changes, pricing of additional work, consequences of delay and the records to be used for handover. Matters requiring technical expert input are identified separately during the legal review.
Progress and delivery
The programme, progress payment records, payments, correspondence and evidence of work on site are compared with the agreement. A handover report is examined to establish which work it covers and whether it records outstanding items or reservations. Delivery of keys, commencement of use and the contractual delivery obligations are assessed in the circumstances of the particular matter.
Incomplete or defective work
Article 474 of the Turkish Code of Obligations requires the employer to inspect the work as soon as the ordinary course of events allows after delivery and to notify the contractor of defects within an appropriate period. Article 477 addresses the consequences of acceptance, inspection and notification; notification also matters when defects emerge later. Delivery dates, discovery of defects, the content of notices and available records are therefore reviewed together.
Claims concerning incomplete work, defects and delay are identified separately. Technical reports, photographs, records and contract annexes help establish how each problem relates to the agreed obligations. If repairs or appointment of another contractor are being considered, preservation of evidence and the legal consequences of that step require assessment beforehand.
Documents for the initial review
The agreement and all annexes, drawings, permits, progress payment records, invoices, payment records, handover reports, correspondence and any technical reports should be considered together. The dates of photographs, when the reported problems first became apparent and the current stage of the work should also be identified.
