Short-term holiday lets under Law No. 7464

Law No. 7464, published on 2 November 2023, brought short-term letting of homes under a separate permit regime. In places like Bodrum with many holiday homes and daily lets, it has direct consequences for owners and site managements alike.

Which lets are covered?

Under Article 2, a tourism let is the letting of a residence to users for up to one hundred days for any purpose. Lets of more than one hundred days at a time fall outside the Law.

The permit and its conditions

Under Article 3, a permit from the Ministry of Culture and Tourism must be obtained before any tourism lease is signed, and the Ministry's plaque must be displayed at the entrance. The obligation to obtain the permit lies with the landlord.

The application requires a resolution approving the activity, adopted unanimously by all owners in the building. On sites with several buildings, this applies only to the building concerned. In buildings with more than three units, permits can be issued to the same landlord for at most twenty-five per cent of them.

A tenant may not relet a home rented as a residence as a tourism let. If someone other than the landlord is to run the lets, this can only be done through licensed group (A) travel agencies.

Sanctions

Article 4 provides for heavy administrative fines, applied per property or per contract, for letting without a permit, acting as an intermediary for unlicensed lets, failing to display the plaque and breaching information duties. Listing platforms are also within scope if they do not remove content after the Ministry's warning. Article 5 sets out the grounds on which a permit is cancelled.

Our view

In Bodrum the main obstacle is often the unanimity requirement. Reviewing the management plan and site resolutions in advance shows whether an application is feasible at all. For site managements, tracking permits and including a clear provision in the management plan reduces disputes between neighbours.
