Divorce and family law in Bodrum

Spouses and parents, including foreign nationals and families of different nationalities, can discuss divorce, arrangements for children, maintenance and marital property in English. Where a matter has a foreign element, questions about documents issued abroad and the applicable law are identified at the outset.

A family law review begins by establishing the parties’ circumstances and the issues to be resolved. Divorce, arrangements for children, maintenance and property questions can affect one another. The sensitivity of information about family life is taken into account, and matters requiring urgent assessment are identified separately.

Divorce and settlement terms

Where an agreed process is being considered, the parties’ intentions, agreed matters and outstanding questions are reviewed. Terms concerning payments, delivery, contact with children and property need to be clear about their scope. The claim addressed by each provision and its potential future consequences are assessed before signing. In a contested matter, events, allegations and their supporting evidence are considered separately.

Children, maintenance and immediate needs

The child’s age, daily life, education and care arrangements, the parents’ circumstances and existing decisions are reviewed together. Income, expenses, needs and payment records are considered in relation to maintenance. Possible interim arrangements and the available applications are assessed in the particular circumstances. Any reported safety or protection needs receive early attention.

Property and documents

A property review considers acquisition dates, sources of funding, title and account records, debts and previous agreements. The scope of divorce-related claims and property claims, and their relationship, require separate assessment. Existing decisions, documents served, proposed agreements, income and expense records, and a short chronology can assist the initial review. The lawful use of available evidence is examined; access to another person’s private accounts or records without authority is not a method of collecting documents for the matter.
