Condominium and site management in Bodrum

Owners in Bodrum apartment buildings and residential sites, including owners living abroad, can seek advice in English about the management plan, owners' meetings and resolutions, service charges and the use of common areas.

A dispute involving an apartment building or residential development begins with the legal structure of the property and its management arrangements. Questions about the use of a unit, common areas, service charges or a resolution are assessed alongside title and management documents. Seasonal and continuing occupation of a development in Bodrum may raise different practical needs, while the applicable rules still require a document-based review.

The management plan

Article 28 of the Condominium Law treats the management plan as an agreement binding all unit owners. The plan addresses the manner of management, the purpose and manner of use, and other management matters. The current plan and its amendments are considered alongside the statutory provisions. The relationship between a subsequent resolution and the management plan requires separate assessment.

Meetings and resolutions

Meeting notices, agendas, attendance and representation records, minutes and records of notification are reviewed together. The review establishes which body made the decision, the matter it addressed, the people affected and the alleged irregularity. Where a challenge is being considered, application requirements and time limits are checked using the actual meeting and notification information.

Service charges and shared expenses

The period and expense items covered by a claim, its supporting resolution or operating budget, the allocation method and payment records need to be established. The management’s claim and an owner’s or occupier’s objection are considered against the same records. Previous payments, any claimed deductions and notifications are reviewed to identify the amount in dispute and its basis.

Common areas and use

Claims about use or alteration of common areas, maintenance, repairs or the use of a unit require the approved plans, management plan, resolutions and actual circumstances to be examined together. Matters requiring technical assessment are distinguished from the legal questions. Once the parties, documents and problem to be resolved are identified, the available discussion or application routes can be assessed.

Article 18/B of Law No. 6325 requires an application to mediation before bringing a court action in disputes arising under the Condominium Law No. 634. This requirement is checked against the nature of the matter and the intended procedure.

Documents for the initial review

The management plan and amendments, title information, meeting notices, minutes, operating budget, expense and payment records, notifications and any technical documents are considered together. The unit or common area affected and how long the problem has continued should also be identified.
